1. Who these terms are between
These terms are an agreement between you and Dream Agency d.o.o., Božidara Magovca 54, 10000 Zagreb,
Croatia (OIB [to be filled in]) ("we", "us"). They apply to the Radijo mobile app for iOS and Android, including
its CarPlay and Android Auto interfaces, to the Radijo API at api.radijo.app, and to the website at
radijo.aboutdream.io (together, "the service").
By installing or using the app or the website you accept these terms. If you do not accept them, do not use the service. Contact: support@aboutdream.io.
2. What Radijo is
Radijo is a directory and player for internet radio stations. It lists stations, plays their streams, shows the "now playing" information the station broadcasts, fetches artist artwork from public databases, and lets you keep favourites and see your listening history. The service is free of charge and shows no advertising.
We do not operate any radio station. The audio you hear comes directly from the broadcaster's own servers; see section 6.
3. No account; your device identifier
Radijo has no user accounts. The app identifies your installation with a random device identifier and a device token, as described in the Privacy Policy. Your favourites and history are linked to that identifier.
The app can adopt another installation's identifier ("import device ID") so that favourites and history carry over to a new phone. You may import only an identifier that belongs to you. Keep your identifier private: anyone who knows it can use, change or delete the favourites and history linked to it, and we cannot distinguish that person from you.
4. Your right to use the app
We grant you a personal, non-exclusive, non-transferable, revocable right to install and use the app on devices you own or control, for private, non-commercial listening. The app, its name, its logo and its design belong to us or our licensors. Open-source components included in the app are licensed under their own terms, listed in the app.
5. Acceptable use
You must not:
- use the service in a way that breaks the law or infringes anyone's rights;
- interfere with the service or the API, for example by sending automated requests, circumventing rate limits, probing for vulnerabilities, or using another installation's device token or identifier without permission;
- copy, modify, distribute, sell or rent the app, or reverse-engineer it beyond what mandatory law allows;
- submit stations, bug reports or other content that is unlawful, offensive, misleading, that contains malware, or that includes personal data of other people;
- use the service to record, redistribute or resell broadcasters' streams where the broadcaster does not permit it.
We may deactivate an installation that breaches these terms; a deactivated installation can no longer use the API.
6. Radio stations and other third-party content
- Streams. Stations are operated by independent broadcasters. When you play a station, the app connects your device directly to the broadcaster's streaming server. We do not control the availability, quality, content or legality of any stream, and we are not responsible for it. Broadcasters may change or stop their streams, apply geographic restrictions, or collect data under their own policies.
- Now-playing information (artist, title) is whatever the station broadcasts; it may be missing, delayed or wrong.
- Station names and logos belong to the respective broadcasters. Artist images and biographies come from TheAudioDB (theaudiodb.com) and are subject to its terms; we display them for identification only.
- If you are a broadcaster or rights holder and want a station or an image removed or corrected, write to support@aboutdream.io and we will act promptly.
7. Content you send us
- Station submissions. You may propose a station through our submission form. Submit only stations you are entitled to submit (the broadcaster's own stream address and public website). We decide whether and how to list a station and may edit or remove listings at any time.
- Bug reports. When you send a bug report, you send us the description you write and, if you choose, technical log files from the app. Do not include personal information in the description. You grant us the right to use what you send to investigate and fix problems.
- Feedback. Suggestions you send us may be used without obligation or compensation.
8. Notifications
The app may ask permission to send push notifications, for example when artwork for an artist you looked up becomes available. You can turn them off in your device settings at any time.
9. Availability and changes
We provide the service as a free product. We may change, suspend or discontinue any part of it, add or remove stations, and release updates at any time. We try to keep the service available, but we do not promise uninterrupted or error-free operation. You use it at your own risk in situations where an interruption could matter (for example while driving: follow the road-safety rules of your car's CarPlay or Android Auto system).
10. No warranty
To the extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of station or now-playing information, and availability of any stream.
11. Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of data, or damage resulting from third-party streams or content, from interruptions of the service, or from the use of your device identifier by someone else. Nothing in these terms excludes or limits liability for intent or gross negligence, for death or personal injury caused by negligence, or any liability that cannot be excluded under Croatian or EU consumer law. Your statutory rights as a consumer are not affected.
12. App stores
If you obtained the app from Apple's App Store or Google Play, the store's own terms also apply. Apple and Google are not parties to these terms, are not responsible for the app or its support, and — in Apple's case — are third-party beneficiaries entitled to enforce these terms against you.
13. Privacy
How we handle personal data is described in the Radijo Privacy Policy at radijo.aboutdream.io/privacy,
which forms part of these terms.
14. Ending the agreement
You may stop using the service at any time by uninstalling the app; to delete the data linked to your device identifier on our servers, follow the Privacy Policy. We may end the agreement and deactivate an installation if you breach these terms or if we discontinue the service.
15. Governing law and disputes
These terms are governed by the laws of the Republic of Croatia. Disputes are subject to the jurisdiction of the competent courts in Zagreb, Croatia. If you are a consumer living in another EU member state, you keep the protection of the mandatory rules of your country and may also bring proceedings there.
16. Changes to these terms
We may update these terms. The current version is always at radijo.aboutdream.io/terms with its effective
date; for material changes we will inform you in the app or on the website before they take effect. Continued
use after that date means you accept the updated terms.
